TERMS OF SERVICE

OVERVIEW

This website is operated by Haley Eliza LLC, doing business as LEATHER AND LARIAT. In these Terms, “we,” “us” and “our” mean LEATHER AND LARIAT and Haley Eliza LLC. By visiting our site or purchasing from us, you agree to these Terms of Service and to our Refund Policy, Shipping Policy and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the site or place an order.

1. USING OUR STORE

You must be at least the age of majority in your state, or have a parent or guardian's permission, to use this site. You may not use our site or products for any unlawful purpose, or try to hack, disrupt or gain unauthorized access to our site or systems.

2. PRODUCTS & AVAILABILITY

We make every effort to describe and photograph our products accurately, but colors and appearance may vary by screen, lighting and production. Many items are available in limited quantities and may sell out. We may limit quantities, discontinue products or change our offerings at any time.

3. SIZING

Sizing varies by brand and style. Please review sizing details and measurements before ordering, and reach out with questions before you buy. Fit or sizing preference is not a defect.

4. PRINTED, HANDMADE & MADE-TO-ORDER ITEMS

Some items are printed, assembled or finished by hand. Small variations in print placement, color or appearance are a normal part of the process and are not defects. Please follow any care instructions provided.

5. CUSTOM & PERSONALIZED ITEMS

Personalized items are made exactly as you enter them. You are responsible for checking all names, spelling, dates and options before ordering. We are not responsible for errors in information you provide.

6. PREORDERS

Preorder items are not yet in stock. Estimated ship dates are listed on the product page and are our best estimate; they may change because of supplier or production delays. If your order includes preorder and in-stock items, it may ship together once all items are available unless stated otherwise.

7. PRICING & PAYMENT

All prices are in U.S. dollars and may change without notice. If an item is listed at an incorrect price due to an error, we may cancel the order and refund you in full. Payment is processed securely through our ecommerce platform and its payment partners.

8. DISCOUNTS & PROMOTIONS

Unless stated otherwise, discount codes cannot be combined, cannot be applied to past orders, have no cash value and may exclude certain items. We may end or change a promotion at any time.

9. ORDERS & CANCELLATIONS

We may refuse or cancel any order, including for suspected fraud, pricing or inventory errors, or violations of these Terms. If we cancel an order after payment, we will refund you in full. You may request a cancellation only before your order has been processed, printed or shipped; personalized and made-to-order items cannot be canceled once production starts.

10. ALL SALES FINAL

All sales are final. We do not accept returns or exchanges or issue refunds or store credit, except for items that arrive damaged or defective, or orders we sent incorrectly, as described in our Refund Policy. Such issues must be reported within 3 days of delivery.

11. SHIPPING & RISK OF LOSS

Processing and delivery times are estimates, not guarantees. You are responsible for entering a correct shipping address. Once an order is handed to the carrier, it is in the carrier's care, and we are not responsible for packages lost or stolen after being marked delivered. See our Shipping Policy for details.

12. CHARGEBACKS

If you have a problem with your order, please contact us first at LEATHERANDLARIAT@gmail.com so we can help. Filing a chargeback for an order that was delivered as described, or in violation of our all-sales-final policy, may result in cancellation of future orders.

13. GIFT CARDS

Gift cards may be used toward purchases on our site, are not redeemable for cash except where required by law, and are not refundable.

14. INTELLECTUAL PROPERTY

The LEATHER AND LARIAT name, logo, designs, graphics, photos and website content belong to Haley Eliza LLC or its licensors. You may not copy, sell or use them commercially without our written permission.

15. REVIEWS & CUSTOMER CONTENT

If you submit reviews, photos or tags, you confirm you have the right to share them and that they are not unlawful or offensive. We may remove content at our discretion, and we'll ask permission before using your photos in advertising.

16. THIRD-PARTY SERVICES

Our site uses third-party services such as payment processors, shipping carriers and apps, which have their own terms and privacy policies. We are not responsible for their independent operation.

17. DISCLAIMER OF WARRANTIES

To the extent allowed by law, our website and products are provided “as is” and “as available.” Nothing in these Terms excludes warranties or rights that cannot be excluded by law.

18. LIMITATION OF LIABILITY

To the fullest extent allowed by law, LEATHER AND LARIAT and Haley Eliza LLC are not liable for any indirect, incidental, special or consequential damages, and our total liability for any claim related to an order will not exceed the amount you paid for that order.

19. INDEMNIFICATION

You agree to hold LEATHER AND LARIAT and Haley Eliza LLC harmless from claims arising from your misuse of our site, your violation of these Terms or your violation of anyone else's rights.

20. GOVERNING LAW

These Terms are governed by the laws of the State of Texas and the United States, without limiting any consumer rights that apply under the law.

21. SEVERABILITY & WAIVER

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of it.

22. CHANGES TO THESE TERMS

We may update these Terms at any time by posting the new version on this page. Continuing to use the site after an update means you accept the changes.
